These Terms of Service ("Terms") govern your access to and use of the Southern California Motorcycles website and online store located at socalmotorcycles.com (the "Site"), operated by Southern California Motorcycles ("we," "us," or "our"). By accessing or using the Site, placing an order, or making a purchase, you agree to be bound by these Terms. If you do not agree, do not use the Site.
1. Eligibility
You must be at least 18 years of age to use this Site or make a purchase. By using the Site, you represent that you meet this requirement and that all information you provide is accurate and complete.
2. Products and Pricing
We make every effort to display our products and pricing as accurately as possible. However, we do not warrant that product descriptions, images, pricing, or other content on the Site is accurate, complete, current, or error-free. Colors may vary depending on your monitor settings. All prices are listed in U.S. dollars.
We reserve the right to correct any errors in pricing or product information and to cancel any orders placed at an incorrect price. If an item you ordered is listed at an incorrect price, we will contact you before processing the order. In the event of a pricing error, you will have the option to cancel the order or confirm it at the correct price.
Product availability is subject to change without notice. We reserve the right to limit the quantity of any product sold and to discontinue any product at any time.
3. Orders and Payment
By placing an order, you are making an offer to purchase a product. All orders are subject to acceptance and availability. We reserve the right to refuse or cancel any order for any reason, including but not limited to product availability, errors in pricing or product information, or suspected fraudulent activity.
Payment must be made at the time of purchase. We accept major credit cards, debit cards, and other payment methods as displayed at checkout. You represent that you are authorized to use the payment method provided. All payments are processed securely through Shopify Payments and our authorized payment processors.
You agree to pay all charges incurred by you or on your behalf through the Site, including applicable taxes and shipping fees.
4. Shipping
We ship to addresses within the United States only. Orders of $75 or more qualify for free standard shipping within the continental United States. Orders under $75 are charged a shipping rate calculated at checkout.
We ship via UPS, FedEx, and USPS depending on package size and destination. Standard shipping typically arrives within 3–7 business days after processing. Processing time is 1–2 business days. Expedited shipping options are available at checkout.
Delivery times are estimates and are not guaranteed. We are not responsible for delays caused by shipping carriers, weather, holidays, or other circumstances beyond our control. Risk of loss and title for items purchased pass to you upon delivery of the items to the carrier.
Some items may be available for in-store pickup only at our Brea, California location and cannot be shipped. These items are clearly marked on the product page.
5. In-Store Pickup
Free in-store pickup is available at our location: 515 W Lambert Rd, Brea, CA 92821. You will receive an email notification when your order is ready for pickup. Please bring a valid photo ID that matches the name on the order. Orders not picked up within 14 days may be cancelled and refunded.
6. Returns and Exchanges
Items may be returned within 30 days of delivery. To be eligible for a return, items must be unworn, unused, and in their original packaging with all tags attached. Refunds are issued to your original payment method. Please allow 5–10 business days for your refund to appear after we receive and inspect the returned item.
We offer exchanges on all eligible items. If you need a different size or color, contact us and we will assist you.
Customers are responsible for return shipping costs. We recommend using a trackable shipping method, as we cannot be held responsible for items lost in transit. If you received a defective or incorrect item, contact us and we will provide a prepaid return label at no cost to you.
Helmets and Electronics: Due to safety regulations, helmets and electronics are not eligible for refunds. We offer exchanges for a different size or color, provided the item is in new, unused condition with all original packaging and tags.
Sale Items: Items purchased on sale are eligible for exchange only. No refunds are issued on sale items.

7. Intellectual Property
All content on this Site, including but not limited to text, graphics, logos, images, product descriptions, and software, is the property of Southern California Motorcycles or its content suppliers and is protected by United States and international copyright, trademark, and other intellectual property laws. Manufacturer names, logos, and product names are trademarks of their respective owners and are used for identification purposes only.
You may not reproduce, distribute, modify, display, or create derivative works from any content on this Site without our prior written consent.
8. User Accounts
You may create an account on the Site to facilitate your purchases. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use of your account. We reserve the right to suspend or terminate accounts at our discretion.
9. Prohibited Conduct
You agree not to: (a) use the Site for any unlawful purpose; (b) interfere with or disrupt the operation of the Site; (c) attempt to gain unauthorized access to any part of the Site; (d) use automated systems such as bots, scrapers, or crawlers to access the Site; (e) submit false, misleading, or fraudulent information; or (f) infringe upon the rights of others.
10. Disclaimer of Warranties
The Site and all products are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components.
Product warranties, if any, are provided by the manufacturer. Please refer to the manufacturer's warranty documentation included with your product for specific terms and coverage.
11. Limitation of Liability
To the fullest extent permitted by applicable law, Southern California Motorcycles and its owners, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Site or the purchase of any products, including but not limited to damages for loss of profits, data, or other intangible losses, regardless of whether we have been advised of the possibility of such damages.
Our total liability for any claim arising out of or related to these Terms or the Site shall not exceed the amount you paid for the specific product giving rise to the claim.
12. Indemnification
You agree to indemnify, defend, and hold harmless Southern California Motorcycles and its owners, officers, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to your use of the Site, your violation of these Terms, or your violation of any rights of a third party.
13. Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any dispute arising out of or related to these Terms or the Site shall be resolved exclusively in the state or federal courts located in Orange County, California, and you consent to the personal jurisdiction of such courts.
14. Changes to These Terms
We reserve the right to update or modify these Terms at any time without prior notice. Changes take effect immediately upon posting to the Site. Your continued use of the Site after any changes constitutes your acceptance of the updated Terms. We encourage you to review these Terms periodically.
15. Severability
If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.
16. Entire Agreement
These Terms, together with our Privacy Policy, Shipping Policy, and Return Policy, constitute the entire agreement between you and Southern California Motorcycles with respect to your use of the Site and supersede all prior agreements and understandings.
